What Form BOC-3 Actually Does
Form BOC-3 is the FMCSA filing used to designate process agents. A process agent is a representative who can receive court papers and other legal documents on behalf of a motor carrier, broker, or freight forwarder. The form is part of the federal registration and operating-authority process; it does not report fuel purchases, fuel-tax rates, or IFTA activity.
Who Needs a BOC-3
For-hire motor carriers, brokers, and freight forwarders may be required to maintain process-agent designations. FMCSA instructions call for an agent in each state where the company operates or through which it travels. Many businesses use a blanket process-agent company that maintains a nationwide network of agents.
Who Can File
FMCSA states that a process agent generally files Form BOC-3 on behalf of the applicant. A broker or freight forwarder applicant without commercial motor vehicles may file on its own behalf. Companies should verify the filer and confirm that the filing appears in the appropriate FMCSA registration record.
What Information the Filing Covers
The filing identifies the carrier, broker, or freight forwarder and lists the designated process agents. It is not an annual fuel-tax return. BOC-3 should not be confused with IFTA reporting, UCR registration, an MCS-150 update, or state fuel-tax filings.
